§ 1. General information

1.1 These general terms and conditions (GTCs) are applicable to all existing contractual relationships between Lost Object S.A, registered in P.O. Box 27, CH -1253 Vandoeuvres and domain www.lostobject.ch (hereinafter "LO"), its service providers and our online store clients and services. They are reserved all and any specific written agreements existing between LO and sub-domains, service providers and customers.

1.2 The commercial relations between LO and the client are subject to Swiss law. Are reserved any mandatory contractual provisions booked by consumer law.

The contractual language is French.

Place of jurisdiction is Geneva, Switzerland.

§ 2. Content and conclusion of contract

2.1

LO offers its customers a digital platform giving them the opportunity to find their objects identified with various Medias equipped with digital codes to remain anonymous. Medias consist of self-adhesive LO labels of different sizes, a LO keychain, LO keyrings, LO tags and LO medal or any LO labeled product, including promotional objects for branding personalization’s.

2.2

Product presentation in the online shop is not a mandatory legal offer, but an online catalog without obligation.However, the client undertakes when sending an order confirmation of goods for sale included in the customer cart by clicking the "Order" button.

2.3

GTCs and Terms and conditions may be accessed by clicking on "Terms and Conditions" or "Terms"

§ 3. Price, shipping, value-added tax and payment.

3.1

Prices listed on the website refer to the services and products offered. All prices are inclusive of VAT.

3.2

Rates do not include freight or delivery costs.

3.3

Costs of delivery may vary according to destination. It is invoiced additionally by LO.

3.4

Delivery to clients is carried out by LO in exchange for one of the following methods of payment:

- PayPal.

- Credit card

- PostFinance.

3.5

If you choose to pay via Visa, Master Card or PayPal, payment will be processed through our Swiss Payment Service Provider ADUNO, in that case, customers are transferred to the proper website to enter payment data. LO it does not record any data related to payment.

3.6

Your account will be charged only after you confirmed the order.

3.7

LO always issues an invoice to the customer, which is sent by email only.

§ 4. Delivery and transfer of risk.

4.1

Delivery is carried out by Swiss Post

4.2

Ordered goods are delivered to the address specified by the customer in the electronic form.

4.3

Shipment of goods is made within max 15 working days unless stock shortage or unforeseen events. In that case, customer will be notified immediately by email.

§ 5. Retention of ownership

5.1

Delivered goods remain LO’s property until settlement of all claims arising from the contract.

§ 6. Liability for defects

6.1

In case of defects, customer can benefit from statutory warranty rights according to the following provisions.

6.2

Damage caused by inappropriate customer’s use, installation, handling or storage gives no warranty rights against LO

6.3

Customer is required to submit its claims to LO within ten working days after receipt.

§ 7. Information duties in case of freight damage

7.1

If goods are delivered with visible packaging or content damage, customer must complain immediately to the carrier, regardless of its warranty rights. He then should get in touch with LO so that LO can assert its rights against the carrier if necessary.

§ 8. Withdrawal information

8.1

Withdrawal

Customer may revoke his contractual statement by written letter or email within two weeks (14 days) without any explanation. The period begins upon receipt of this information in written format by LO, but not before receipt of the goods by the customer (in case of recurring deliveries of similar goods, not before receipt of the first partial delivery). The prompt dispatch of the written cancellation or the goods shall be sufficient to meet the deadline for cancellation.

No refunds provided if customer waives the service during the period of two years (ex. When moving abroad or otherwise).

8.2

Effects of withdrawal?

All LO services ends in case of an effective withdrawal. LO will have no obligations to inform the owner if his items if they are reported lost or found, via the website or phone, after withdrawal or expirations of services.

§ 9. Utilisation de www.lostobject.ch

9.1
LO allows customers to register items they wish to identify using www.lostobject.ch.

9.2

Registration is carried out entering personal data such as name, address, and other contact information, as well as one or more LO code, and a QR code to be assigned to the customer.

9.3

After his registration on www.lostobject.ch, a customer may:

  • Change his contact information and his access data
  • Enter new LO codes
  • Process or delete existing LO codes
  • Renew a subscription
  • Cancel the registration of his items

9.4

A registered customer’s personal data will not be transmitted, but the contact information of the person who found an object will be given to the registered customer via SMS & Email to enable and facilitate the return of the item.

§ 10. Reward

10.1

A customer who gets his belonging back is due to reward the one who provided useful information to find it, according to article number 720 & 722 of the Swiss Civil Code. This award is required only if requested by the person who found the item. In this case, a person who requests a reward, cannot remain anonymous, and will deal directly with the person who has lost his belonging.
